Terms for using the Clearstep website, inquiry process, public content, and online services.
These Website Terms of Use govern use of the Clearstep Systems website, public pages, inquiry forms, login areas, client portal pages, and other online services operated by Pshichenko Enterprises Inc.
By using the website or submitting a project inquiry, you agree to these Terms. If you use the website on behalf of a business, you represent that you have authority to act on behalf of that business.
Business-Only Use
The website and services are intended for businesses located in the United States. They are not intended for consumers, personal household use, or children. You may not use the website or services if you are under 18.
Project Inquiries
Submitting a project inquiry does not create a client relationship, guarantee a response, guarantee acceptance of your project, or obligate Clearstep to provide services. Clearstep may decline inquiries for any reason, including fit, capacity, risk, location, data sensitivity, budget, scope, or business conflicts.
Do not submit confidential, regulated, or highly sensitive information through the public inquiry form. If sensitive information is needed for a project, Clearstep will request it through a more appropriate process.
No Professional Advice or Guaranteed Results
Website content is for general business and informational purposes only. Clearstep does not provide legal, medical, tax, accounting, investment, insurance, or financial advice.
Clearstep may describe possible business benefits of better systems, workflows, software, automation, and AI-assisted tools. Clearstep does not guarantee revenue, profit, savings, margin improvement, customer growth, rankings, lead volume, operational results, AI accuracy, uninterrupted service, or any specific business outcome.
Acceptable Use
- Do not violate law or third-party rights.
- Do not submit false, misleading, abusive, unlawful, or infringing content.
- Do not upload malware, harmful code, or security threats.
- Do not attempt unauthorized access to systems, accounts, data, or networks.
- Do not interfere with website operation.
- Do not scrape, copy, or harvest data in an abusive manner.
- Do not submit regulated or highly sensitive data through public forms unless specifically requested and authorized.
- Do not use the services for unlawful, deceptive, or harmful purposes.
Accounts, Access, and Website Materials
If you receive access to a login area or client portal, you are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify Clearstep promptly if you suspect unauthorized access.
Clearstep may suspend or restrict access if it believes there is a security risk, misuse, nonpayment, legal risk, or violation of these Terms or another agreement.
The website, content, design, copy, graphics, code, branding, service names, process descriptions, and other materials are owned by Clearstep or its licensors, except where otherwise stated. You may view the website for business evaluation purposes, but may not copy, resell, redistribute, or create derivative works from website content without written permission.
Third-Party Links and Client Services
The website may link to third-party tools, providers, platforms, or resources. Clearstep is not responsible for third-party websites, terms, privacy practices, availability, security, or content.
Paid work, audits, scoping, software builds, support, retainers, and managed system expansion are governed by the applicable proposal, invoice, statement of work, service agreement, payment terms, AI & Data Processing Policy, support terms, and any other written agreement between Clearstep and the client. If there is a conflict, the signed agreement controls for that paid client work.
Client Acceptance of Paid Terms
By approving a statement of work, paying an invoice, clicking acceptance, or authorizing work to begin, the client agrees to the Clearstep Systems Client Service Terms, Payment & Refund Terms, AI & Data Processing Policy where applicable, Privacy Policy, and the project-specific scope.
Payments, Disclaimers, and Liability
Payments may be processed by Stripe or another payment provider. Payment provider terms apply to payment processing. Clearstep does not intend to store raw payment card numbers.
The website and public content are provided as is and as available. Clearstep disclaims warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy, and error-free operation.
To the maximum extent permitted by law, Clearstep will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages arising from or related to the website, inquiry process, public content, or use of the website. For website use not connected to a paid statement of work, Clearstep's total liability will be limited to $100 or the maximum amount permitted by law, whichever is greater.
Indemnification, Law, Changes, and Contact
You agree to defend, indemnify, and hold harmless Clearstep from claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the website, violation of these Terms, violation of law, or submission of information you did not have the right to provide.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing a claim, the parties agree to make a good-faith effort to resolve the dispute informally by written notice and discussion for at least 30 days. Either party may bring qualifying claims in small claims court. For claims that must be filed in court, venue will be in Placer County or Sacramento County, California, unless applicable law requires otherwise.
Clearstep may update these Terms from time to time. Continued use of the website after an update means the updated Terms apply to later use.
